Question:

What can a lawyer do to save a home after auction in Illinois?

Answer:

Unfortunately, if your home has been auctioned off in a foreclosure auction in Illinois, there is very little that anyone can do to help you. While there may be lawyers that can save home after auction Illinois if the home did not sell, once the house sells, then it is owned by the new owner and you have no recourse under the law. If the home does not sell at the auction, you may be able to save your house by buying it back from the bank, if they accept your offer.

Since an auction is the final step in a foreclosure, and since the home is lost forever if it is purchased in a foreclosure auction, you should strongly consider speaking with a lawyer as soon as it becomes apparent you are facing foreclosure. By getting help earlier in the process, you can take some steps to either stop the foreclosure or to delay it until you are able to come up with the cash to save your house.

Examples of things you  may be able to do to help stop foreclosure or to delay it include:

  • Negotiating with the lender to defer your payments for a period of time. This will suspend the requirement that you make monthly payments, and the amount you aren't paying will be tacked on to the bills later or at the end
  • Changing the terms of the mortgage. Various programs may allow you to alter the interest rate, the repayment term or even the balance owed on the mortgage
  • Requesting that the lender "show the note." If they can't, this will delay or even stop the foreclosure
  • Declaring bankruptcy, which will put an automatic stay on the foreclosure action and buy you some time to get your finances in order.

The sooner you call a lawyer, the better your chance of saving your home.
