What is a Notice of Trustee Sale?

In California foreclosures, a notice of trustee sale constitutes the formal notification of the sale of a foreclosure property.  The notice of trustee sale includes the following information:

  • the date of the sale
  • the time of the sale
  • the location of the propert which is the subject of the sale

In California foreclosures, the notice of trustee sale is filed ninety days following a notice of default when a property owner has failed to make a property loan current; in other words, the property owner has failed to provide the payments owed on the loan and therefore remains in default on the loan.  The notice of the trustee sale will then be posted on the property which is being sold.

In addition, the State of California requires that the notice of the trustee sale be published in a specified newspaper for three weeks.  This publication requirement mandates that the property description include tax assessment information, sale information, opening bid data, outstanding property loan information and other basic information relating to the property
