What is a workout agreement & can it stop foreclosure?

If a homeowner defaults on mortgage payments and doesn’t do anything to remedy this quickly, then that person will lose his or her home. A lender will try to seize a delinquent borrower’s home so that all the money he lent may be paid back, regardless of whether the debt is a result of a tax lien, adverse court judgment or mortgage default. Under these circumstances, a borrower can resort to legal remedies, or negotiation, or even bankruptcy protection.
Depending on the circumstances of the borrower, he or she may have the chance to arrange for an agreement – also called a workout agreement – with the lender, so that foreclosure is halted or, buy more time for the borrower before the foreclosure is finalized. In arranging for a workout agreement foreclosure may be avoided – but in negotiating the agreement, the borrower is better off to have as much money as possible, so that any outstanding balances may be paid.
Certain states permit a borrower to redeem a property by repaying mortgage outstanding balances, including fees and foreclosure costs. In addition to this, there are some irregularities in the technicality of the foreclosure process which the borrower can use to have the foreclosure sale deemed as invalid. Sometimes, if there is an issue with the mortgage, the borrower may question the mortgage agreement itself. Meanwhile, if the borrower is dealing with a federal loan like a Federal Housing Administration Loan, then the lender is expected to comply with given guidelines and regulations.
