My
house just got foreclosed upon and I am living with a family member for the
time being. Prior to the foreclosure, I planted a fairly large garden in my
backyard. Would I have any rights to retrieve some of vegetables and flowers I
have recently planted? I live in

Answer: (1)
Interpreting foreclosure property rights can be rather complex. If you are hoping to gain back all of your rights to your house, you should consult with an attorney to see if the deadline has passed for you to seek formal redemption of it.
However, if you really are just interested in retrieving some of the vegetables and flowers you planted, you need to consider several factors. If the sheriff’s deed of foreclosure has not yet been served on you, you may still have a right to return to the property for your garden plants and flowers. In other words, your home owner rights for property on land in foreclosure may still be valid.
If you have been served with the sheriff’s deed, cutting off your full rights to the property, you should seriously consider consulting with an attorney to avoid any chance of being sued for trespass. It’s always wise to seek legal help when trying to determine foreclosure property rights.
