When someone is facing foreclosure, the lenders are the ones who are going forward with the whole thing. This is why one important tactic to avoiding foreclosure includes lender negotiation, or simply speaking with the lenders to try to work something out so they don't foreclose on the home. In some cases, something will be worked out in the end, and chances are increased drastically when a foreclosure lawyer is involved.

With proper negotiation, a lender may consider:

  • A short sale
  • Waiving or reducing payments for the time being
  • Setting up a payment plan to help pay back the unpaid mortgage payments
  • Adding any unpaid balance to the loan and increasing future payments to cover the added amount

Many home owners that have fallen behind on their mortgage payments are often very fearful of losing their home, but are even more scared to initiate communication with their lender. Even worse, some individuals will flat out ignore any contact attempts from their lender, thinking that talking to them is just a waste of time. This is not a good thing to do! Explaining the situation to the lenders and using a lawyer to help in the negotiation process may just save the home.

When all else fails and a lender won't settle on any other options, one option they may agree on is something called a "short sale". A short sale will not save the home, but it will prevent foreclosure which is a good thing because foreclosure will destroy someone’s credit.
